Patent Law Degree Questions

Here are some things to think about as you consider if you want to become a patent law attorney

Lacy H. From Kansas wants to know about…

I am interested in a patent law degree but have some questions?

Can you give me an idea of some opportunities in the field of patent law? What type of degree would I need? Also, I’m a little confused on this part… if I am a patent attorney, would I be filing inventor’s patent applications?

Hmm, I’m not sure which direction to go with your questioning. Forgive me, but it’s all over the place. I’ll try and do the best I can. Usually if you are a Patent Attorney you would either work for a law firm or for a corporation (think Google). Those are not your only options, however they are the most common. To get a better idea, go to The Jobs Report and look at all the opportunities… both with and without a patent law degree.

Patent LawyerTo be a Patent Lawyer, you will need a law degree, should also have a technical degree, and will need to take and pass the patent bar. The best description of those qualifications can be found at the USPTO itself. A patent agent does not need a law degree.

One of the jobs of a Patent Lawyer can certainly be to file patent applications for clients. However, whether YOU will be doing this depends on the job you’ve been hired to do. Again, you’ll get a better picture of what’s available to you by taking a look at jobs available on The Jobs Report and taking notes. Abby

Jenny M. From Maine wants to know about…

Can I get a patent law degree if I’ve been arrested?

When I was in college, about 4 years ago, I had a couple of DUI’s. I’ve since cleaned up my act and graduated a couple of years ago with a BS in chemical engineering. Do you know if this would prevent me from getting a patent law degree?

Sorry Jenny, that’s waaaay out of my league. I do know, in order to be admitted to the bar (not the Patent bar), you’d have to pass drug tests and I think background checks to prove good moral character. I tried to do some research on this. Good Moral Character isn’t just a “term”. In law, it is actually a defined legal concept. In fact, it’s a WELL defined legal concept which you can read more about here. I didn’t know this until now!

I think, if I were in your shoes, I’d call the state bar and ask.Abby

Richard L. From DC wants to know about…

What’s the best degree for patent law?

Hi Abby! I’ve been admitted to a university for Bioengineering. Now I’m thinking I’d like a degree in Chemical Engineering . But I’m not sure which one is more beneficial?I really don’t want to go Electrical Engineering. What would you recommend?

Hi Richard. I haven’t a clue. Sorry. However, if it were me, I’d go with what interested me. Patent Law aside, are you more interested in bioengineering or chemical? Which field would you be happier working in if you decide somewhere down the road you aren’t interested in pursuing patent law? Put all your options in front of you and that will give you a better idea. Abby
